By purchasing an admission ticket, you enter into a contract with the bathing establishment and thereby recognize the following bathing regulations as legally binding.

1) Oblig­a­tions of the bathing facil­i­ty
1.1 Grant­i­ng use of the facil­i­ties, assump­tion of risk by guests (1) The bathing estab­lish­ment allows guests to use the facil­i­ties of the bathing estab­lish­ment at their own risk with­in the frame­work of the pro­vi­sions of these bathing reg­u­la­tions. (2) It is not pos­si­ble for the bathing facil­i­ty or its staff to gen­er­al­ly pre­vent dan­gers or acci­dents. In par­tic­u­lar, guests them­selves bear any per­son­al health-relat­ed risks asso­ci­at­ed with their use of the bathing facil­i­ty. The same applies to injuries and oth­er intru­sions into the per­son­al sphere of the bathing guest by oth­er guests or oth­er third par­ties who are not mem­bers of the bathing facil­i­ty staff. (3) Th ebathing facil­i­ty assumes only the fol­low­ing oblig­a­tions towards guests. 1.2 Open­ing hours and grant­i­ng of access (1) The bathing facil­i­ty is required to allow access to the facil­i­ty dur­ing the open­ing hours announced on the notice board or by the bathing staff. (2) If the per­mit­ted num­ber of vis­i­tors is exceed­ed, the bathing facil­i­ty may pro­hib­it access to fur­ther vis­i­tors with the help of the respon­si­ble staff. In such cas­es, vis­i­tors must expect wait­ing times (3) The bathing com­plex reserves the right to refuse entry to per­sons whose admis­sion to the baths appears ques­tion­able with­out giv­ing rea­sons. (4) Ani­mals are not per­mit­ted. Excep­tions are ser­vice dogs of the police and res­cue ser­vices as well as guide dogs, assis­tance dogs and part­ner dogs, inso­far as this is nec­es­sary for the ful­fill­ment of their tasks. 1.3 Con­di­tion and oper­a­tion of the facil­i­ties (1) The bathing estab­lish­ment is respon­si­ble for ensur­ing that the facil­i­ties are set up, oper­at­ed and main­tained in accor­dance with reg­u­la­tions. In par­tic­u­lar, the bathing facil­i­ty must com­ply with all applic­a­ble hygiene and safe­ty reg­u­la­tions. The bathing estab­lish­ment has no fur­ther oblig­a­tions. (2) As soon as the bathing facil­i­ty becomes aware of a mal­func­tion, defect or dam­age to the facil­i­ty or indi­vid­ual areas that no longer guar­an­tee safe oper­a­tion, the bathing facil­i­ty shall imme­di­ate­ly pro­hib­it the use of the facil­i­ty or restrict its use in an appro­pri­ate man­ner. 1.4 Mon­i­tor­ing com­pli­ance with the bathing reg­u­la­tions The bathing com­plex mon­i­tors com­pli­ance with the bathing reg­u­la­tions by guests and oth­er per­sons present on the bathing com­plex premis­es as far as is rea­son­able with the help of its respon­si­ble staff. If irreg­u­lar behav­ior is detect­ed, the per­sons con­cerned will be warned and may be expelled from the facil­i­ty if nec­es­sary. 1.5 Assis­tance in the event of acci­dents The employ­ees of the bathing facil­i­ty will pro­vide first aid as soon as rea­son­ably pos­si­ble or will ini­ti­ate the nec­es­sary assis­tance mea­sures. If nec­es­sary, first aid mate­ri­als are avail­able for bathers from the pool staff. In the event of an acci­dent, all bathers are required by law to pro­vide first aid until the arrival of qual­i­fied emer­gency ser­vices. Acci­dents must be report­ed to the pool staff as soon as pos­si­ble. 1.6 Assis­tance in the pre­ven­tion of report­ed dan­gers If an immi­nent dan­ger to the health or life of guests is report­ed to the bathing facil­i­ty by guests, in par­tic­u­lar to the respon­si­ble staff, the bathing facil­i­ty will make rea­son­able efforts to avert this dan­ger imme­di­ate­ly with the help of its staff. 1.7 Vis­its to the bathing facil­i­ty by peo­ple with dis­abil­i­ties Peo­ple with dis­abil­i­ties must assess for them­selves whether and to what extent they are able to use the respec­tive bathing facil­i­ty. If peo­ple with dis­abil­i­ties require assis­tance, the pool staff may be asked for sup­port, which must be pro­vid­ed prompt­ly, with pri­or­i­ty, pru­dent­ly and in a ser­vice-ori­ent­ed man­ner, depend­ing on the assess­ment of the sit­u­a­tion, the nature of the request and capac­i­ty. 1.8 Super­vi­sion of under­age and adult minors and non-swim­mers (1) The per­sons oth­er­wise respon­si­ble for the super­vi­sion of minors and non-swim­mers who are under the age of major­i­ty and of legal age shall be respon­si­ble for the appro­pri­ate super­vi­sion of these per­sons. (e.g. legal guardians, rel­a­tives or appro­pri­ate super­vi­sors or care­givers) must pro­vide appro­pri­ate super­vi­sion for these per­sons. When using the attrac­tion facil­i­ties, the duty of super­vi­sion is increased. The duty of super­vi­sion remains in force even if the per­son respon­si­ble for super­vi­sion does not enter the premis­es of the pool oper­a­tor or leaves the premis­es pre­ma­ture­ly. (2) The applic­a­ble youth pro­tec­tion reg­u­la­tions, in par­tic­u­lar alco­hol and smok­ing bans, as well as oth­er oblig­a­tions of those respon­si­ble for super­vi­sion or guardians etc. must be observed by the young peo­ple and their super­vi­sors or guardians. (3) Non-swim­mers and chil­dren up to the age of 10 may only enter the bathing estab­lish­ment with an accom­pa­ny­ing and super­vis­ing per­son. 1.9 Super­vi­sion of group vis­its (1) In the case of group vis­its, the respon­si­ble super­vi­sor or, in the case of clubs and oth­er orga­ni­za­tions, the respon­si­ble offi­cial must ensure com­pli­ance with the bathing reg­u­la­tions and bear full respon­si­bil­i­ty for this. The rel­e­vant super­vi­sors must be present for the entire dura­tion of the group vis­it. (2) These super­vi­sors must main­tain due con­sul­ta­tion with the super­vi­so­ry staff of the bathing facil­i­ty in order to ensure that oth­er nor­mal bathing oper­a­tions are not dis­turbed by the group vis­it. 1.10. Lia­bil­i­ty of the bathing facil­i­ty (1) The bathing estab­lish­ment is only liable for dam­age caused to bathers by it or its staff as a result of unlaw­ful, in par­tic­u­lar non-con­trac­tu­al, and cul­pa­ble behav­ior. The bathing facil­i­ty accepts no lia­bil­i­ty for dam­age to third par­ties caused by objects brought in by guests. (2) The bathing facil­i­ty is not liable for dam­ages caused by dis­re­gard­ing the bathing reg­u­la­tions, any oth­er reg­u­la­tions for use or by dis­re­gard­ing the instruc­tions of the staff, by oth­er own fault of the injured par­ty or by unavoid­able events or force majeure, in par­tic­u­lar also by inter­ven­tions by third par­ties. Con­trib­u­to­ry neg­li­gence shall lead to a cor­re­spond­ing appor­tion­ment of dam­ages. The same applies anal­o­gous­ly to any spe­cial rules of use post­ed at the respec­tive equip­ment and facil­i­ties (e.g. for the slide, div­ing tow­er, sauna, etc.) as well as any pro­hi­bi­tions or restric­tions on use with­in the mean­ing of point 1.3. para. 2.

2.1 Admis­sion tick­ets, keys, data car­ri­ers, pre­paid cards; charges

(1) Use of the bathing facil­i­ties is only per­mit­ted with a valid admis­sion tick­et accord­ing to the price list. The price list is part of the bathing reg­u­la­tions.

(2) Admis­sion tick­ets must be kept for the entire dura­tion of the vis­it to the baths. Lost admis­sion tick­ets will not be reis­sued. The vis­i­tor must leave the baths or pur­chase a new admis­sion tick­et.

(3) A deposit may be required for keys or data car­ri­ers issued on the basis of the applic­a­ble price list.

(4) The admis­sion tick­et, issued keys or val­ue cards must be returned when leav­ing the baths.

(5) Lost keys or data car­ri­ers must be replaced. Con­sump­tions booked are to be paid for by the cus­tomer.

2.2 Instruc­tions of the bathing facil­i­ty staff

(1) Guests are oblig­ed to fol­low the instruc­tions of the respon­si­ble bathing facil­i­ty staff with­out restric­tion.

(2) Any­one who vio­lates the bathing reg­u­la­tions or bans on the use of cer­tain facil­i­ties of the bathing com­plex (e.g. slide, div­ing tow­er, sauna) or restric­tions with­in the mean­ing of point 1.3. para. 2 or dis­obeys the instruc­tions of the respon­si­ble staff may be expelled from the baths by the staff or anoth­er rep­re­sen­ta­tive of the bathing com­plex with­out any enti­tle­ment to a refund of the admis­sion fee.

(3) In par­tic­u­lar­ly seri­ous cas­es, a ban on future vis­its may also be imposed. In the event of non-com­pli­ance, the guest is liable to pros­e­cu­tion for tres­pass­ing.

(4) In the event of approach­ing storms, the instruc­tions of the pool staff must be fol­lowed and, if nec­es­sary, the out­door pools must be left in good time for safe­ty rea­sons.

2.3 Hygiene reg­u­la­tions

(1) Bathers are oblig­ed to main­tain the utmost clean­li­ness in the entire bathing facil­i­ty; a clean­ing charge may be levied in the event of will­ful soil­ing. The bare­foot area may not be entered with street shoes

(2) The bathing facil­i­ty is to be used with nor­mal, hygien­i­cal­ly impec­ca­ble swimwear (e.g. swim­suit, biki­ni, swim­ming trunks, footwear, etc.).

(3) The bathing facil­i­ty may not be vis­it­ed by per­sons with ill­ness­es that could pose a risk to the health of oth­er bathers (e.g. acute risk of infec­tion).

(4) For rea­sons of hygiene, a show­er must be tak­en before enter­ing the pool. The show­ers must be turned off imme­di­ate­ly after use.

(5) The use of soap, sham­poos or deter­gents and the wash­ing of swimwear in swim­ming and bathing pools is pro­hib­it­ed.

(6) Shav­ing, hair col­or­ing, man­i­cures and pedi­cures are not per­mit­ted in the entire facil­i­ty, includ­ing in the show­ers and chang­ing rooms.

(7) Waste (bot­tles, glass­es, cans, paper, etc.) must be dis­posed of in the waste con­tain­ers pro­vid­ed.

2.4 Refrain­ing from haz­ards and nui­sances

(1) Every bather is oblig­ed to show con­sid­er­a­tion for oth­er bathers, espe­cial­ly with regard to noise. They must there­fore refrain from doing any­thing that could dis­turb or even endan­ger oth­er bathers.

(2) The bound­aries of the bathing area may not be trans­gressed.

(3) All facil­i­ties and equip­ment in the baths may only be used for their intend­ed pur­pose (e.g. children’s pad­dling pool, non-swim­mer area, water slides).

(4) The usu­al rules of decen­cy applic­a­ble in pub­lic facil­i­ties must be observed. Any immoral, sex­u­al or oth­er offen­sive inti­mate acts are not per­mit­ted and may be pun­ished with a ban from the premis­es (with­out reim­burse­ment of admis­sion fees already paid) and crim­i­nal charges.

(5) Pho­tograph­ing and film­ing peo­ple with­out their express con­sent is strict­ly pro­hib­it­ed.

 

2.5 Jump­ing area

(1) Div­ing is only per­mit­ted in pools or parts of pools des­ig­nat­ed for this pur­pose, at the times pre­scribed for this pur­pose and in accor­dance with the instruc­tions of the pool staff.

(2) Div­ing may be restrict­ed or pro­hib­it­ed if there is a cor­re­spond­ing num­ber of vis­i­tors.

(3) Jumpers must ensure on their own ini­tia­tive that oth­er bathers are not endan­gered.

(4) In the div­ing area, guests in the water must take spe­cial care to ensure that they do not endan­ger them­selves or oth­er bathers due to the div­ing oper­a­tion. Swim­mers and divers must show con­sid­er­a­tion for each oth­er.

(5) In div­ing pools or parts of pools set up exclu­sive­ly for this pur­pose, use by oth­er bathers dur­ing div­ing oper­a­tions is only per­mit­ted to the extent that smooth div­ing oper­a­tions that do not endan­ger bathers are pos­si­ble. Instruc­tions giv­en by pool staff must be fol­lowed in all cas­es.

2.6 Use of pools, equip­ment etc.

(1) The equip­ment and facil­i­ties offered in the pool (e.g. water slides) are to be used in accor­dance with the rules of use.

(2) Users of the equip­ment and facil­i­ties must ensure that oth­er bathers are not endan­gered. Bathers who are in the vicin­i­ty of equip­ment and facil­i­ties must ensure that the users of the equip­ment and facil­i­ties do not endan­ger them­selves or oth­er bathers. Bathers must be con­sid­er­ate of each oth­er and there is a spe­cial duty of super­vi­sion for minors.

(3) The instruc­tions of the staff must be fol­lowed at all times.

2.7 Use of addi­tion­al facil­i­ties

(1) Sun loungers, table ten­nis equip­ment and oth­er facil­i­ties may be used for as long as stocks last, sub­ject to a cor­re­spond­ing usage fee.

(2) Each bathing guest may only use one seat­ing or loung­ing area. If this is not used, a longer-term reser­va­tion by plac­ing tow­els, bags, etc. is not per­mit­ted.

If nec­es­sary, these items may be removed by the pool staff

(3) Com­pen­sa­tion must be paid for any dam­age to the seat­ing or sun­bathing areas.

2.8 Deposit and loss of items

(1) Valu­ables must — if pos­si­ble — be deposit­ed at the pool cash desk against receipt or locked in the lock­ers pro­vid­ed for this pur­pose; no lia­bil­i­ty is accept­ed for valu­ables oth­er­wise brought into the pool area.

(2) Any items found must be hand­ed in at the pool cash desk against receipt. These will be kept in accor­dance with the legal reg­u­la­tions or hand­ed over to the author­i­ties.

(3) No lia­bil­i­ty is accept­ed for the theft or loss of unat­tend­ed valu­ables (cell phone, wal­let, etc.).

2.9 Con­sump­tion of food, alco­hol and bev­er­ages

(1) Food and drinks may only be con­sumed in the des­ig­nat­ed areas.

(2) The use of glass­ware is pro­hib­it­ed in the bare­foot area.

2.10. Mis­cel­la­neous

(1) Any kind of com­mer­cial activ­i­ty or adver­tis­ing in the area of the bathing facil­i­ty requires the con­sent of the own­er of the facil­i­ty.

(2) The gen­er­al smok­ing ban in Sec­tion 13 (1) of the Tobac­co and Non-Smok­ing Act (TNRSG) applies. Smok­ing is only per­mit­ted in the des­ig­nat­ed areas.
